    THE 52-1 DISTRICT COURT

    Located on Grand River in Novi Michigan, the 52-1 District Court covers the cities of Novi, South Lyon, Wixom, and Walled Lake.  The 52-1 Court also has jurisdiction over Milford, Highland, Commerce, Lyon, and Novi Townships.  Finally, the 52-1 District Misdemeanor Court includes the villages of Milford and Wolverine Lake.  Additionally, each of these judges has their own methods of dealing with drunk driver cases.

    POSSIBLE SENTENCES

    Although Judge Bondy, Judge MacKenzie, and Judge Powers are all tough on drunk drivers, I have found that they are normally willing to place a first time offender on probation.  However, this probation can and will be lengthy and require going to classes, alcoholics anonymous, and paying a lot of fines and costs.  As to second offense DUI, jail is a real possibility, although I have had plenty of clients receive probation for their 2nd offense drunk driving in the 52-1 District Court.

    MOTIONS

    Each Judge may have their own opinions regarding the state of the law, but I have found all three judges to be receptive to motions.  Having won motions before all three judges, I am a great proponent of bringing difficult motions before them as I feel all three are not afraid to make a tough decision when it comes to the preservation of your rights.

    THE 52-1 JUDGES

    Judges Brian MacKenzie, Robert Bondy, and Dennis Powers are the three Judges who adjudicate drunk driving OWI Operating While Impaired charges.  Each of these judges has their own sentencing philosophies as it pertains to drunk driving trials and DUI sentencing.  Another important part of the 52-1 District Court philosophy is that any bond or probation violation will be met with harsh penalties, including jail.

    WHAT YOU NEED TO KNOW ABOUT THE 52-1 DISTRICT COURT

    This Court, more than any other court in the Oakland County drunk driver Misdemeanor courts, requires an experienced attorney who knows the judges and knows how to navigate the judges’ chambers.  I have had many cases in the Novi District Court and I have a working relationship with all three judges.  I have also won trials, dismissals, and major charge reductions in this Court.
